General Terms and Conditions of Use

1. Definitions

HDSI: HEALTHCARE DIGITAL SOLUTION INTELLIGENCE & APPLICATION.

Parsimed: the e-health project developed by HDSI and accessible via mobile apps and the website.

Application: the Parsimed mobile application for iOS and Android.

Service(s): any service offered by HDSI within the Application (see Section 4).

User: an individual who creates an account and uses the Application, in accordance with applicable U.S. law.

2. Preamble

Before registering, the User acknowledges having been clearly informed of these General Terms and Conditions of Use ("GTC") and any information necessary to finalize account creation. Registration constitutes full acceptance of these GTC. Any conflicting document shall be unenforceable against HDSI.

3. Purpose

These GTC define the conditions under which the User subscribes to and uses the Application and Services. By checking the relevant box in the Application, the User confirms having read and accepted these GTC without reservation.

4. Description of the Services

A questionnaire-based screening aid ("ParsimedEndoScore") that helps assess the likelihood of endometriosis based on User-provided responses. Important ParsimedEndoScore is not a diagnosis and does not replace a clinical evaluation.

4.1 Areas & Features

Available areas include ”My Parsimed", "Home", "Menstrual Well-being Test", "ParsimedEndoScore", and "Quiz". These features are informational and educational, designed to help Users understand symptoms and pain.

4.2 Medical Disclaimer

Intended Use. ParsimedEndoScore assists screening by generating a risk indication derived from a questionnaire. It is provided for informational purposes only, does not provide medical advice, does not establish a patient-provider relationship, and is not a substitute for professional diagnosis or treatment.

No Emergency Service. The Services are not intended for emergencies. In case of emergency, call 911 or your local emergency number.

5. Access to the Service

5.1 Account & Credentials

To use the Application, the User creates an account with accurate and complete information. Login credentials are personal and must be kept confidential. The User is responsible for all activity under their account and should secure devices (e.g., screen lock, strong passwords) and log out after use. If credentials are lost, compromised, or misused, contact: info@Parsimed-endo.fr.

5.2 Availability

HDSI may suspend, modify, or discontinue the Services temporarily or permanently (e.g., maintenance) without liability. Network conditions, device compatibility, and having the latest app version are the User's responsibility. HDSI provides the Services on a reasonable-efforts basis.

5.3 Privacy Policy Acceptance

Registration implies acceptance of these GTC and the Privacy Policy.

7. Price and Payment

Access to the "ParsimedEndoScore" paid feature is charged at the price displayed in the Application at the time of purchase, inclusive of applicable taxes based on the User's billing location. Purchases are processed via Stripe or another secure third-party payment provider. Prices may change, and promotional offers may be available from time to time.

Non-use of the Application after purchase does not entitle the User to a refund (see Section 8).

8. Refunds & Cancellations

Unless required by applicable U.S. federal or state law, all payments are final and non-refundable. HDSI may, at its sole discretion, grant a refund in cases of a verified service failure attributable to HDSI.

9. Confidentiality

HDSI uses reasonable safeguards to maintain the confidentiality of information. The confidentiality obligation does not apply to information that is public, already known to HDSI without breach, independently developed without use of confidential information, or required to be disclosed by law, regulation, or court/administrative order.

10. Security & HIPAA

HDSI implements administrative, technical, and physical safeguards designed to protect information under its control.

10.1 HIPAA & Hosting

To the extent HDSI receives, maintains, or transmits Protected Health Information ("PHI") on behalf of a covered entity or business associate, HDSI will comply with applicable provisions of the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and its implementing regulations. Hosting is performed on HIPAA-ready infrastructure provided by reputable U.S. providers. Backups and disaster-recovery measures are maintained on a commercially reasonable basis.

10.2 Encryption

Data is encrypted in transit and at rest using industry-standard encryption. Access is controlled via authentication and time-limited tokens.

11. Intellectual Property

HDSI owns all rights, title, and interest in and to the Services, including software, algorithms, trademarks, logos, content, and documentation. Any reproduction, modification, distribution, or derivative use without prior written consent of HDSI is prohibited and may result in civil and criminal liability.

12. Personal Data & Privacy

By using the Application, the User consents to the collection and processing of personal data as described in the Privacy Policy. Where applicable, additional HIPAA notices may apply to PHI. The Privacy Policy explains what data is collected, how it is used, and User choices.

13. Notifications (Email/SMS)

As part of the Service, Users may receive push notifications, emails, SMS, MMS, alerts, or other messages. Users provide consent at sign-up and may opt-out at any time as described in the messages or the Application settings.

Marketing emails comply with the CAN-SPAM Act. SMS/MMS communications comply with the Telephone Consumer Protection Act (TCPA) as applicable. Standard message and data rates may apply.

Administrative messages (e.g., terms updates, pricing changes, or safety notices) may still be sent where permitted by law.

16. Changes to the GTC

HDSI may modify these GTC at any time, for example to reflect legal, regulatory, or operational changes. The latest version will be posted in the Application or on the website. Continued use of the Services after changes become effective constitutes acceptance.

17. Force Majeure

HDSI shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, acts of government, failures of telecommunications or networks, or other force majeure events.

18. Severability

If any provision of these GTC is held invalid or unenforceable, the remaining provisions shall remain in full force and effect.

19. Applicable Law & Jurisdiction

These GTC and any dispute arising out of or relating to them shall be governed by the laws of the State of Delaware, United States, without regard to conflict of laws rules. The parties agree to the exclusive jurisdiction and venue of the state and federal courts located in Delaware.

These Terms are written in English, and the English version controls.
